A recent Queensland case has highlighted the disappearing divide between home life and work, and the need for employees to take care with comments made on social media sites.
An employee was sacked after he posted derogatory comments about his work and supervisor on his Facebook page. The employee lodged a claim for unfair dismissal on the grounds that his privacy settings were set to maximum and that he had not named his employer anywhere on his profile.
Fair Work Australia rejected his claim for unfair dismissal, saying that the employee’s actions had justified his sacking on grounds of misconduct, that other employees had read his comments and that it did not matter that he had posted the comments from his home computer outside of work hours.
