Our fixed fee ‘Simple Divorce’ promises clients a smooth transition into the next phase of their lives free from the burden of unforeseen legal costs.
What is included in a ‘Simple Divorce’?
elringtons’ fixed fee ‘Simple Divorce’ includes:
- The preparation of your Application for Divorce, whether made jointly or solely.
- Correspondence between our office and you.
- Meeting with you to witness your signing of the application.
- In cases of a sole application, our office will organise for a process server to serve the other party. This will include preparing all the paperwork required by the Court when using a Process Server.
- Filing of all required documents with the Court.
Is my matter a ‘Simple Divorce’?
A simple divorce is either an Application for Divorce made jointly or solely.
For a fixed fee in sole applications, the following criteria applies:
- You must know the other party’s residential address and ideally, their workplace address.
- The other party must accept service.
If the other party can’t be served by the process server and substituted service is required, additional costs will be incurred.
In addition to the fixed fee, you will be required to pay Court filing fees that is currently $1,100*, Process Servers costs and other disbursements which may arise.
What supporting documents are required?
The following documents are required to file an Application for Divorce:
- A marriage certificate. If the marriage certificate is not in English, a translated copy of the marriage certificate with copies of the original and the translation attached to an affidavit from a certified translator. Please note that if you require our assistance with this than additional fees may apply.
- Proof of citizenship or residency in Australia for the past 12 months (e.g. your citizenship certificate or visa paperwork)
- Certificate from marriage counsellor if you have been married for less than two years
What is not covered by the fixed fee?
The following is a non-exhaustive list of professional work that your application may require us to complete, and which would not be covered under the ‘fixed fee’:
- Engagement and cost of a translator if the marriage certificate is not in English.
- Preparation and execution of an affidavit if you and the other party were separated but living under the same roof within 12 months of the application being made.
- Preparation and execution of an affidavit if you or the other party have changed names throughout the course of the marriage.
- Preparation of any application and supporting documents for substituted services if the other party is unable to be served by hand (in person) or an acknowledgement of service is unable to be obtained.
- Attendance at the hearing for the application (if applicable).
