In a time of increasing uncertainty, Australian Courts are currently changing the way they are dealing with the matters before them.
Each Court has taken a different approach and the measures taken are evolving day to day, to stay in line with the Government advice in relation to COVID.
For some clients, the need for a quick resolution in their matter is more urgent now than ever. It is important that clients are aware of the government measures put in place and the impact Government services including the legal system and what that may mean for their legal matters.
What can you do to ensure that the disruption to your matter is kept to a minimum?
- Seek legal advice
If you are worried that the nature of your matter may be effected by the measures taken to slow the spread COVID-19, including the changes to the Court’s procedures. Please email or telephone us to discuss this.
- Check the Courts website for updates.
The Courts are actively updating their websites and media releases on their websites, to update practitioners and parties in relation to any changes in Court procedure and why these measures are in place.
Your legal representatives will contact you directly in the event they are advised that a Court event in your matter has been adjourned.
- Explore out of Court solutions
In a climate where there may be significant delays to the Interim and/or Final determination of your matter, it is an important time to look at alternative dispute resolution.
- Remain Flexible, Remain Practical
It is extremely important that you remain flexible and practical in dealings with the individuals, legal representatives and Courts at this time. It may be that parties need to be more lenient in relation to certain aspects of your matter or the enforcement of agreements and/or Orders at this time.
